State school board member Mary Scott Hunter said today she regrets that the state's new list of so-called "failing schools" identified under the Alabama Accountability Act includes those that have made significant improvement in recent years.
But she also says that could change in the future.
"I regret that the list included schools that have been making tremendous progress for years and, to my thinking, should not have been included," she said.
"The mechanics of the definition of 'failing' under the AAA did not allow Dr. Bice to exercise discretion. I expect this limitation may be rectified in the future."
