Judge Tells Birmingham School Board to Stop Interfering in State Takeover After Alabama Files Suit

A judge signed a temporary restraining order today telling the Birmingham Board of Education that it must stop interfering with the state school superintendent's takeover of the school system, as a new front opened in the legal battle between state and Birmingham school boards.

Jefferson County Circuit Judge Elisabeth French made the order in response to a lawsuit filed by Tommy Bice, the state superintendent, and state Attorney General Luther Strange against the Birmingham board and its members.

It is the second lawsuit filed in Jefferson County courts since the Birmingham board suddenly voted 5-3 Tuesday to fire the embattled city school superintendent, Craig Witherspoon.
